As agreed between members of the Association of Model Agents - all clients should read this carefully before booking a model. All bookings will be subject to these term and conditions.
Booking Confirmation Forms
Upon confirmation of all bookings a booking confirmation form will be sent by Close Management to the client, which must be signed and returned by the client prior to the commencement of the engagement.
Fees
1. All Fees are based on the model's quoted daily or hourly rate. Daily rates are based on an 8-hour day which includes a lunch-break (excluding Equity contracts). Overtime rates apply outside 0900-1800 hours (see below). The minimum booking is 2 hours. Extra half hours or parts of half hours shall be paid for at half the hourly rate. Agreed expenses will be added to the fees.
2. All fees quoted are for the UK only, for 1 year within 18 months of the booking unless otherwise agreed in writing. Rates for all foreign bookings or additional foreign usages must be clearly requested and are to be separately negotiated.
3. An additional rate is payable for use of the photographs, or reproductions or adaptations thereof, or drawing therefrom, either complete or in part, alone or in conjunction with any wording or drawings, other than the 'permitted use'. The 'permitted use' will be editorial, unless otherwise agreed that it is to be for experimental photography or press advertising. If the client wishes to use the model for posters, packaging, display material (i.e. showcards, swing tickets, etc) and record covers, this must be clearly stated and the client is responsible for negotiating an additional rate payable for each of these categories at the time of the booking.
4. It is not permitted to use photographs for any purpose whatsoever until all fees have been paid.
5. All fess quoted are exclusive of VAT.
6. Agency Fees. An agency supplement of 20% is chargeable on all models and usage fees.
7. All fees will be invoiced by Close Management.
Overtime
1. The overtime rate is 1.5 times the normal hourly rate between 18:00and 00:00 hours.
2. A special rate will be negotiated for night work between 00:00 and 09:00 hours.
3. Work on Saturdays is 1.5 times the normal rate.
4. Work on Sundays and Bank Holidays is double the normal rate.
Payment
Payment is required within a maximum of 30 days of date of invoice. In all cases the person or entity booking the model will be invoiced and solely responsible for payment, unless otherwise agreed at the time of the booking. All fees are for the right to use pictures and, once agreed, are payable whether or not such use is made.
Restrictions on a Model
A special fee will be negotiated when the work is in connection with a product or service which precludes work for competing products. It is the CLIENT'S responsibility to check whether conflicting work has been done. It must be understood that if a model advertises a product she is able to work for any competitor unless an exclusion fee is negotiated.
Travel
Travel time will be charged at 50% of the hourly rate. This applies to travel outside a five mile radius of Hyde Park Corner (i.e. Chiswick in the West, Golders Green and Highgate Village in the North, Mile End in the East, Streatham Hill and Tooting Bec in the South).
Location Booking - (i.e. outside 5 miles radius of Hyde Park Corner)
At the time of the location booking, clients must provide information about available transport. If a model on location is prevented from returning to London after a booking to work for the remainder of the working day, half daily fee is paid.
Meals
Clients are responsible for model's meals.
Cancellations
If a booking is cancelled within one working day of the starting time of the booking the full fee is charged, unless the same model is re-booked for that day within 24 hours, in which case half the fee will be charged. If a booking is cancelled outside the one-day period but within two working days of the starting time of the booking, then half the fee will be charged. However, if a booking is cancelled because of illness or some other reason beyond the model's or agent's control (and upon the production of the appropriate evidence) the model shall not be liable for cancellation charges.
For trips and long bookings; if the booking is cancelled within a period equal to the length of the booking then the full fee is charged.
Saturdays, Sundays and Bank Holidays are excluded in calculating cancellation periods.
Weather-Permitting Bookings
First cancellation at half-fee (unless a model arrives at booking through the client's failure to cancel in time). Second cancellation at full fee.
TV Bookings
As per British Actors Equity Association. (NB Equity ìminimumsî are only a guidelineî)
Video
Based on a daily rate to be agreed ñ minimum 100% buy out every 6 months.
Provisional Bookings
Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking, or if a definite booking is offered by another client and the provisional cannot be confirmed with the original client.
Test & Experimental Photography
A photographer is not entitled to use test and experimental photography for commercial purposes unless specific arrangements have been made with the agency before the photographic session.
Copyright
The photographer is not entitled to use any of the images he/she takes for any usage beyond that agreed in accordance with section 3 of the paragraph headed Fees above. The client to this extent agrees to restrict use of its copyright, and, if the client is not a photographer, the client then agrees to draw these terms and conditions to the attention of the photographer and procure his/her agreement to them before the shoot commences.
Fittings & Hairdressing Fees
Fees to be a minimum of 50% of the hourly rate (with a minimum £40 per hour).
Complaints
Any cause for complaint should be reported to Close Management during the course of the booking or immediately afterwards. Complaints will not be considered in retrospect.
Assignment
The client shall not assign or otherwise transfer any of its rights or obligations in relation to the booking to any third party without the prior written consent of Close Models.
Please Note
All fees are to be negotiated only with Close Management.
Photographs may not be used until all fees are paid in full.
Close Management is acting as an agent in relation to all bookings and whilst every endeavour will be made to provide a satisfactory and efficient service to clients, Close Management cannot be held responsible for a model's conduct on an assignment ( including, for example, delayed arrival or failure to complete booking). As the supplier of services, these terms and conditions take precedence over any terms and conditions which may be received from the client, even if those terms and conditions have a clause similar to this.
These terms and conditions are without prejudice to any claim against the client.
